Capacity as Data Controller

Pursuant to the KVKK, as HR Effect in our capacity as Data Controller, we will record, store, process, classify, and update your personal data for the purposes set out below, in accordance with the law and the rules of honesty, and to the extent and in the cases permitted by the KVKK and related legislation. Your personal data are processed within the limits provided in the applicable legislation and limited to our processing purposes.

Purposes of Processing Your Personal Data

Your personal data are processed in accordance with the fundamental principles set out in the KVKK and related legislation so that you can benefit from the services we offer as HR EFFECT, based on the legal grounds of establishment/performance of a contract (KVKK Art. 5/2-c), fulfilment of our legal obligations (Art. 5/2-ç), establishment/exercise/protection of a right (Art. 5/2-e), and protection of legitimate interests (Art. 5/2-f). Where these grounds cannot be relied upon, processing is based on your explicit consent. Considering the services provided by HR Effect, your personal data are processed in our recruitment and human resources processes, processes relating to our business relationships, technical processes, in order to meet the requests of third parties, and in the conduct of the Company’s commercial activities. They are stored securely in physical and electronic environments for an appropriate period consistent with the purpose of processing. In this regard, HR Effect acts in accordance with its obligations under all applicable legislation, primarily the KVKK.

Method of Collection of Your Personal Data and Legal Basis

Your personal data are collected through the different channels set out below for the conduct of our activities, as HR Effect provides human resources services and operates as a private employment agency

• Personal data provided directly by you to HR EFFECT: All information and documents you submit to us;
• Personal data collected about you from third parties: Information and documents collected from institutions and organizations and/or clients with which HR EFFECT cooperates, and from official institutions such as the Turkish Employment Agency (İŞKUR);
• Personal data we collect via cookies and similar technologies.

Your personal data may be collected through HR Effect Headquarters, its branches, the websites of HR Effect and/or partner institutions, and similar other channels, by automated or non-automated means, in written, oral, or electronic form.

Within this framework, your personal data are processed and may be transferred based on the legal processing conditions under KVKK Art. 5/2 in light of the principles set out in KVKK Art. 4/2; where these conditions cannot be relied upon, upon obtaining your explicit consent; and your Special Categories of Personal Data may be processed and transferred without obtaining your explicit consent where the circumstances provided in Art. 6/3 exist.

Transfer of Your Personal Data

Within the processing purposes listed above, our Company may share the personal data it obtains with our group companies, direct/indirect business partners, clients with which we have agreements and to which we provide services as required by our activities, suppliers, business partners, independent audit firms within legal limitations, or public institutions or organizations authorized to request such data due to a legal obligation, and other relevant institutions and organizations, without limitation to these, based on your explicit consent or in other cases provided under KVKK Art. 5/2, primarily applicable legislation, in accordance with the personal data processing conditions and purposes regulated under KVKK Art. 8 and Art. 9, limited to our activity purposes.

Transfer of Personal Data Abroad

Your personal data may be transferred by HR Effect in accordance with the general principles set out in KVKK Art. 4/2 and the rules regulated under KVKK Art. 9.

Your Rights under KVKK Art. 11

First, it is important that the personal data we process and/or store are accurate and up to date due to the nature of the commercial activity carried out by HR Effect. Accordingly, if any change occurs in your personal data, we kindly ask you to inform us as soon as possible

On the other hand, as the data subject, subject to the cases provided in the “Exceptions” provision regulated under KVKK Art. 28, pursuant to Article 11 of the Law, by applying to our Company, you have the right regarding your personal data to;

• a) learn whether they are processed,
• b) request information if they have been processed,
• c) learn the purpose of processing and whether they are used in accordance with their purpose,
• d) learn the third parties to which they are transferred domestically / abroad,
• e) request correction if they are incomplete / incorrectly processed,
• f) request deletion / destruction within the framework of the conditions provided in Article 7 of the Law,
• g) request that the operations carried out pursuant to subparagraphs (e) and (f) above be notified to third parties to whom they have been transferred,
• h) object to the occurrence of a result against you by analyzing them exclusively through automated systems,
• i) request compensation for damage if you suffer damage due to unlawful processing.

In this context, when exercising your rights, you must submit your requests to HR Effect in “writing” or by the methods determined by the KVKK. As the Personal Data Protection Board has not yet determined any other method, written submission of your requests is currently required. For this purpose, you may apply in person to our Company’s address at Beştepe Mah. 31.Sok 2/B No:104 Kollektif House Yenimahalle | Ankara with identity-verifying documents together with a written petition containing your explanations regarding the right you wish to exercise, or you may submit this request to HR Effect via notary or with a secure electronic signature
